The Choctaw 8(a) Advantage
As a federally chartered Tribal corporation wholly owned by the Choctaw Nation of Oklahoma, Choctaw Workforce Solutions (CWS) is advantageously positioned to operate as part of the 8(a) Business Development program. We are eligible for FAR compliant (FAR 13 CFR 124.506) sole-source contracts up to $25 million with civilian agencies and $100 million from the DoD with no Justification and Authorization (J&A) required. For a sole source with a total contract value exceeding $25M (civilian agency limit) and $100M (DoD limit), the sole source can be granted if accompanied by the proper J&A.

The Tribal 8(a) contract vehicle reduces the procurement timeline from months to weeks, allows for the selection of a qualified contractor of choice, to negotiate costs, gives more control of scope and budget, and the award cannot be protested. Contracts can be initiated with a simple high-level Statement of Work.
Helps Government Agencies Meet Small Business Goals
These contracts may be negotiated to ensure the procuring agency meets its program needs while ensuring the government gets best value for the agency and taxpayers. The specific legal authorities providing these advantages are:
13 CFR 124.506(b): Tribal entities are not subject to the standard $4M dollar threshold limitations on sole‐source contract awards that are applicable to other 8(a) entities. Instead, sole‐source contracts may be awarded to Tribal entities up to $22M without justification.
FAR 19.808-1(a): Under the 2020 National Defense Authorization Act specific to the Department of Defense, sole‐source contracts may be awarded to Tribal entities up to $100M without justification.
48 CFR 6.303.1: Tribal entities may receive sole-source contracts for any amount above the $22M threshold with proper Justification & Authorization.
FAR 6.302-5(b)(4): Tribal entities may receive sole-source contracts from the Department of Defense for any amount above the $100M threshold with the simplified Justification & Authorization process.
13 CFR 124.517(a): Tribal entity 8(a) sole‐source contracts may not be protested.
DoD Prime Contractors Get 5% Back
The Native Indian Incentive Program developed is sponsored by United States Congress and allows for a 5% rebate back to prime government contractors on amounts subcontracting to Native American Indian-Owned Companies. This is one of the most under-utilized tools in federal government contracting and definitely is a win-win for both the prime contractor and the Native American Subcontractor.
